What is the E-2 Investor Visa?

The United States has trade agreements with many countries. If you have one of these nationalities, you are a candidate to obtain the E-2 Investor Visa.

 

This visa is designed to allow entrepreneurs to invest in a commercial business in the United States, and thereby be able to move to the U.S. to monitor their investment, accompanied by their family.

 

The E-2 Investor Visa allows the investing family to travel freely within and outside the country, grants a work permit to the spouse and enables children to attend U.S. schools, colleges and universities.

A substantial amount must be invested (a minimum amount of 200,000 USD is recommended)

Unlike EB-5 visas, which by law require a minimum investment amount of 800,000 USD, for the E-2 category there is no specific amount that must be invested in order to obtain approval of the Investor Visa. However, the investment must be "substantial", which will be determined by the nature of the business. In general, it must be a sufficient investment to ensure that the company can operate successfully and create economic well-being and new jobs. For a higher chance of approval, 200,000 USD is usually the recommended minimum investment amount for E-2 visa investments.

You must have control of your business

As an investor holding the E-2 Investor Visa, you must be able to run and manage your business. Your spouse is instead eligible for a work permit and may engage in any legal employment activity.

Your investment must be in a real, not marginal, operational undertaking

Your investment must be in a real business, not a speculative or passive venture. In addition, to be approved for an E-2 Investor Visa, you must demonstrate to the USCIS (U.S. Immigration Service) that you are in the process of investing or have already invested your capital in a business or commercial venture in the U.S. If you are investing with a new company, this can be demonstrated through a business plan that projects growth over a five-year period, as well as the number of American citizens you will hire for the operation of that business.

Regarding the Ownership and Source of Funds

You must be able to prove that you have legitimate ownership and control of the funds you are using to invest. You must be able to document that you earned or obtained the money legitimately, and not through an unlawful business or illegal action. Your immigration attorney will be able to prove this in different ways, such as wage statements, bank statements, dividends, asset sales, donations, etc. Additionally, you must prove that the funds you invest will be irrevocably committed and that they will be "at risk" of possible loss, since if the funds are not at risk your visa under no circumstances will be approved by the USCIS (U.S. Citizenship and Immigration Services).

Who qualifies and how long is the E-2 Investor Visa valid for?

The investor and his or her family (spouse and unmarried children under the age of 21) may live and work in the United States for the duration of the investment, which varies by nationality, but it is usually 4-5 years on a renewable basis if the business remains active and complies with its business plan.
